What Is a Wrongful Death Claim?

A wrongful death claim is a type of personal injury claim that is brought by the surviving family members of a person who was killed as a result of someone else’s negligence, recklessness, or intentional misconduct. These claims are intended to compensate the surviving family members for their losses, including the loss of their loved one’s income, companionship, and support.

Under Louisiana law, a wrongful death claim may be filed by the following individuals:

  • The deceased person’s surviving spouse and children
  • The deceased person’s surviving parents, if there is no surviving spouse or children
  • The deceased person’s surviving siblings, if there is no surviving spouse, children, or parents
  • The deceased person’s surviving grandparents, if there is no surviving spouse, children, parents, or siblings

If the deceased person has no surviving spouse, children, parents, siblings, or grandparents, a wrongful death claim may be filed by the deceased person’s surviving family members “who suffer actual loss as a result of the death.”

Time Limits for Filing a Wrongful Death Claim in Louisiana

In Louisiana, the statute of limitations for wrongful death claims is one year from the date of the deceased person’s death. This means that you have just one year to file a claim and seek compensation for your losses. If you fail to file a claim within this time frame, you will be permanently barred from doing so.

There are very few exceptions to this rule, so it is important that you act quickly. Our Louisiana wrongful death attorneys can help you understand the statute of limitations and ensure that your claim is filed on time.

Compensation for Families in Louisiana Wrongful Death Cases

Wrongful death claims are intended to compensate the surviving family members for their losses. These losses are both economic and non-economic in nature.

Some of the most common types of damages available in a wrongful death claim include:

  • Medical expenses incurred as a result of the deceased person’s final injury or illness
  • Funeral and burial expenses
  • Lost wages and benefits
  • The value of the deceased person’s lost love, companionship, and support
  • The surviving family members’ mental anguish and emotional distress

It is important to note that, in Louisiana, punitive damages are not available in wrongful death claims. Punitive damages are intended to punish the at-fault party for particularly egregious conduct and are not available in any type of personal injury claim in Louisiana.
